The process begins when the Office of Student Conduct (OSC) receives an incident report. Incident reports may come from IUPD, RPS, individual students' conduct conferences, witness or anonymous reports, university faculty or staff, students (including student leaders and governing councils), parents or guardians, community members, and organizations themselves. OSC then assesses the report for credibility, and will initiate an investigation as appropriate. Inter/National Headquarters (HQ) are able to co-investigate when appropriate. When an investigation occurs, a Notice of Investigation may be sent to organization leadership, their primary advisor, and Inter/National Headquarters representative (if applicable). When an incident report is received and assessed by OSC, interim measures may be applied. The period of time for which a Cease and Desist directive remains active will be determined by OSC, in conjunction with OSFL/SILC and Inter/ National Headquarters (if applicable). There may be instances in which a case is directly referred to an Alternative Resolution (see below) without a glean report being prepared. Generally though, OSC will prepare and provide a glean report of investigation findings. The organization will have 14 days to assess the report, take appropriate action as deemed necessary, and provide a written response to OSC. The written response must include: 1. What violations, if any, the organization accepts responsibility for (using the IU Student Code of Conduct) 2. A statement about the identified violations a. If accepting responsibility for any violations of the student code, the organization will suggest an action plan to remedy the violations. b. If not accepting responsibility for any violations of the student code, the organization will provide a statement to address the glean report. 3. Detail regarding any action the organization has taken. Documentation supporting this should be attached, when possible. 4. A request for next steps in the conduct process After receiving the organization's response, OSC will review, determine if the case moves to an Alternative Resolution, Collaborative Action Plan (CAP) Meeting, or Formal Administrative Conference, and provide formal communication of next steps to the Organization President. ALTERNATIVE RESOLUTION If a case moves to an Alternative Resolution, this could include: - Mediation, - Restorative processes, - An Organization Coach referral (OSFL/SILC Staff) - A HQ referral, or - A formal agreement with the Vice Provost of Student Life (VPSA). COLLABORATIVE ACTION PLAN (CAP) MEETING When an organization's process moves to a CAP meeting: 1. To be eligible for a CAP meeting, the student organization must accept responsibility for the alleged misconduct charge, either as the initial reporting party, during the course of the investigation, or prior to a Formal Administrative Conference. 2. The student organization will present a proposed action plan for addressing and correcting behaviors that violate the Student Code, which is initially evaluated by OSC, the Office of Sorority and Fraternity Life (OSFL), and/or the Student Involvement Leadership Center (SILC). 3. At the CAP meeting, the student organization and individuals designated by the OSC will meet to discuss the proposal, modify as necessary, and determine an appropriate action plan. 4. The action plan is reviewed by the VPSA or designee. If accepted, this action plan is considered final. The outcome of responsibility and action plan are not appealable. The action plan will be indicated on the student organization's conduct record. FORMAL ADMINISTRATIVE CONFERENCE When an organization's case moves to a Formal Administrative Conference, the process will go as follows: 1. The student organization will receive official letter outlining the alleged violations, as well as the date, time, and location of the administrative conference. Notice of the administrative conference will be given at least seven (7) calendar days prior to the conference, unless the organization representative(s) elect to meet earlier. 2. The student organization will attend a pre-hearing meeting with a staff member OSFL/SILC to discuss the administrative conference process and review the alleged violations and investigative findings. 3. A Formal Administrative Conference will be conducted by one of two panels: either the SFL Judicial Board consisting of Sorority and Fraternity student panelists (collectively "Student Panel"), or an Administrative Panel consisting of an OSC representative, an OSFL or SILC representative, and a student representative appointed by the VPSA (collectively "Administrative Panel"). The Student/ Administrative Panel will be empowered to issue outcomes and action plans up to and including deferred suspension. Should a Panel determine a case should result in suspension or expulsion of the organization, the Panel may make a recommendation to the VPSA or designee, at which point in time the VPSA will determine the next course of action. a. If an action plan is assigned, it will be indicated on the student organizations conduct record. The outcome of responsibility and action plan are eligible for appeal.
